In these Terms and Conditions “we” and “us” refers to ECCELLENZA- Excellence Made In Italy and ECCELLENZA- Excellence Made In Italy Pty Ltd trading as ECCELLENZA-Excellence Made In Italy and “you” means you the customer. “Products” means any goods supplied by us to you and “Order” means a purchase order for Products placed by you and as varied in writing from time to time by the parties. These Terms and Conditions together with your Order constitute the entire agreement between us and you for the supply of Products. The agreement can only be varied in writing by letter or email.
We have the right to change prices for products displayed on our website at any time before you place an Order. Please note these prices are affected for example in price rises, currency fluctuations, overseas shipping costs, government costs etc. The price of products shown excludes shipping costs. Shipping cost is shown separately please refer to shipping costs table on the product page and is set at a flat rate Australia wide.
Placing Your Order
Assigning an Order with us via our website/e-Boutique or over the telephone you make an offer to us to purchase the products you have selected based on these Terms and Conditions. We will notify you that your Order is being processed by sending you an Order Confirmation and tax invoice via email, we do not formally accept your offer until your Order has passed our internal authenticating processes for validating of each Orders placed, for the reason of preventing fraud with credit card or payments.
Payment Methods and Processing
We accept payment by Visa, MasterCard, American Express and Diners. Payment processing will not begin until we receive all the information we need. You may be required to provide photo identification and for additional security reference checks.
Delivery of Your Products
Please ensure to enter your correct delivery address accurately and completely, as we will not take responsibility for any deliveries which are lost as a result of incomplete or incorrect details due to incompetency or mistakes.
We choose Australia Post to deliver our Products in optimal condition, especially for Orders of wine and other glass packaged Products. Please note we do not deliver to a Post Office Box number a signature is required for acceptance and identifying you are the person who placed the order. If you require a courier, please call or email us to organise.
For demanding periods such as Christmas and Easter, delivery may take up to 7 working days from the date your payment is processed, we cannot guarantee that we will deliver within this time frame. Please note your patience is really appreciated during these busy periods.
Products are products not ordinarily acquired for personal, domestic or household use or consumption, under section 64A of the Australian Consumer Law and similar provisions of relevant state legislation.
If any Products supplied to you as a “consumer” under this agreement, terms and conditions, of goods or services within the meaning of that term in the Australian Consumer Law (as amended) or relevant state legislation, you will have the benefit of certain non-excludable rights and remedies in respect of the Products.
We limit our liability to payment of an amount equal to the lowest of the cost of replacing the Products or supplying equivalent Products, the cost of repair of the Products and the cost of having the Products repaired or replaced.
These Terms and Conditions will be governed by the Victorian Law and construed in accordance with the laws of Victoria and shall be subject to the non-exclusive jurisdiction of the courts of Victoria.

Returns Policy on Damages, Faults and Change your mind
When the delivery has arrived, please check the parcel first as should the parcel show any evidence of damage or leakage, this must be noted when the Products are signed for and then written on the courier’s delivery docket.
If you have received incorrect or broken items, please notify us within 24 hours of receiving the Products either by telephone or email. We will then determine whether to make a refund or provide a replacement, in accordance with your statutory rights under the Australian Consumer Law and relevant state legislation.
For returns to be processed a process requires that most of the content of the Product be returned to us. Bottles of wine should be returned with most of its contents and original cork. Products claimed to be faulty or defective will be assessed/ examined by us, take in consideration some Products may need to be returned to the supplier/ manufacturer for further analysis and testing, this also will take time. We will endeavour to process the situation in a reasonable time, with a gratitude of your patience kept in the process..
If the Product is determined to be faulty/defective we will refund or replace with no hesitation, if it is free of any fault or defect, it will be returned to you and you will be required to pay any costs incurred in freight and testing.
IMPORTANT: Subject to any of your statutory rights under the Australian Consumer Law and relevant state legislation, there are no returns or refunds for confectionery Products.
Any refund that is offered for Orders placed online or over the telephone, it will only be credited back to the original credit card used to make the purchase.
Returning a Product if You “Change Your Mind”
“Change of mind” returns will be judged on the terms of the type of product in query and the condition in which it is returned and will be at the decision of our management team.

We cannot accept the return of opened Products except where a defect has been discovered upon opening the Product. There are no returns or refunds for confectionery Products, Subject to any of your statutory rights under the Australian Consumer Law and relevant state legislation,
Any “change of mind” returns will incur all freight costs for returning products due to will/decision taken by the customer.
